Driver’s License in Georgia with a Pending Application with USCIS

On January 1, 2014, Georgia Senate Bill (SB) 122 became effective which authorizes the issuance of a temporary driving license or identification card to a noncitizen applicant whose Georgia driver’s license has expired, or will expire within 30 days.

Noncitizen applicants must present evidence that they have filed, or on their behalf has been filed, a request for an extension to remain lawfully in the United States. This evidence includes: a receipt notice (Form I-797C) showing a pending application, a pending or approved application for asylum in the United States, an approved application for temporary protected status in the United States, an approved differed action status or any other federal documentation verified by the United States Department of Homeland Security to be valid documentary evidence of lawful presence in the United States. Once the Georgia Department of Driver Services grants the said temporary driving license or identification card to a noncitizen applicant, these become valid for 120 days from the date of the expiration of his or her driver’s license.
