NewsAlert! EB-2 India Retrogression Imminent

We have learnt from Mr. Charles Oppenheim, Chief of the Visa Control and Reporting Division for the Department of State (DOS), that retrogression of employment-based, second preference (EB-2) India would happen as early as November and given the current demand, the dates may possibly move to early 2005.  This is largely due to the huge volume of EB-3 to EB-2 upgrades for Indian-born applicants; this level of demand is expected to continue in the coming months. 

In addition, EB-2 category for Indian became ‘unavailable’ this week and will continue to remain so until October 1, 2014, as the number of immigrant visas that are available for India has been reached.  Any EB-2 case with a priority date earlier than May 1, 2009 may continue to be accepted by USCIS during the month of September, however, instead of being adjudicated, it will be held in the Visa Office’s “Pending Demand” file until start of the next fiscal year, October 1, 2014, at which time eligible cases will be authorized.
