USCIS Issuing RFE for Expiring Medical Exams
It has come to our attention that the U.S. Citizenship & Immigration Services (USCIS) has begun issuing request for additional evidence (RFE) for updated medical exams. As many of our readers know, medical examination report (I-693) is a required document for application for adjustment of status (AOS).
The endorsement of a civil surgeon on Form I-693 is generally valid for one year but given the fact that some AOS are generally pending for a long time, USCIS in the past had temporarily extended the validity of civil surgeon’s endorsement on the Form I-693 until the underlying AOS or temporary residence application could be adjudicated. The most recent extension was issued on September 4, 2013 and is set to expire on May 31, 2014.
USCIS has informed American Immigration Lawyers Association (AILA) that effective June 1, 2014, Form I-693 completed more than a year prior will no longer be valid. USCIS have already started to issue a RFE to the applicants with a pending AOS informing them that the Form I-693 is about to surpass its validity period.
At this time it needs to be seen if a RFE will be issued to all pending AOS applicants or only to those whose priority date will soon become current. Sharma Law Offices will update its readers, as new information is made available to us.
